 Dear Madam Louise Arbour:

Oooooo, lady, just read the TIME on WORLD article, ‘REPORT: The Sins of Sri Lanka’s Great War Victory’, of Wednesday May 19, 2010, by-lined Jyoti Thottam and Amantha Perera, which said, “The International Crisis Group, and international human rights group based in Brussels, released an alarming report on Tuesday, timed to coincide with the first anniversary of the end of Sri Lanka’s war.  The report, “War Crimes in Sri Lanka,” calls for an international inquiry into violations by Sri Lankan security forces, describing several incidents in which civilian targets, including hospitals and humanitarian aid shelters, were shelled.”   Ummmmm….nasty……nasty.  The Government of Sri Lanka has come back saying that all this is damn poppycock.

It looks like you have not cut your  finger nails for a while and they have now grown out to be claws to make it easy to go after Sri Lanka’s President Mahinda Rajapaksa and his administration and draw blood out of them.

What stood out early in that article was the fact that you released the said ‘alarming report’ on Tuesday to coincide the first anniversary of the end of Sri Lanka’s war.  So it was a deliberate and a mischievous act of a nasty nature of vindictive theatrics. Ummm….I don’t like it.  It certainly paints you as a heartless brute of a woman who sings for your ICG paymasters who provide you with the plate of egg and bacon and a bowl of Kellogg cereal at each breakfast.

I understand your anger with the President of Sri Lanka who refused you to place a posting of a Human Rights office in Sri Lanka.  So boo to you lady…you sneak after Rajapaksa like a cobra in the grass to spit your venom at him to bring him down on his knees.  Nasty….nasty!  Mind you, Louise,  Sri Lankans do know how to deal with vipers.

Now, you being a lawyer and taken up playing War Games rather than the gentle ladies game of cricket with Sri Lanka, lets have an honest shoot out between your ICG and the Sri Lankan Government.

What Sri Lanka did was to wipe out the Tamil Tigers on May 18, 2009 militarily. According to the UN the Tamil Tigers were the most ruthless terrorist outfit in the world, which perfected the suicide jacket for human bombs which is now being used around the world by other terrorists in copy cat massacres.  That has got the international bullies like you, Navi Pillay, Ban ki-Moon, David Milliband, Robert Blake, Gareth Evans, Radhika Coomaraswamy, Brad Adams, Chris Patten, Bernard Kouchner and Channel 4 smarting, as if you all have swallowed some Jalapeño chilli peppers.

This Eelam War could have ended differently, if only Prabhakaran had surrendered when requested by President  Mahinda Rajapaksa and to let his people go, when he knew that he had no where to go other than get buried waist deep in muddy waters of the Nandikadal lagoon. And beyond that was the sea where he would have drowned taking with him 300,000 Tamils that he kept as the human shield and drowning them too.  This idiot was stubborn and did not want to surrender.  His police chief, another God damn idiot, and later the Tamil Tiger political wing leader Nadesan said, “We will never surrender.”  So Louise it was Prabhakaran who was the architect of his and his senior army commanders destinies as well as some of the innocent Tamil victims at the latter days of the war.  Prabhakaran and his senior commanders were too cowardly to bite the necklace cyanide-capsule that they expected all their minions to bite when they were about to be captured. So they died with bullet wounds during their arrogant battle thinking they could still win the war and their separate  state, Eelam or perhaps that their Mother India or the  supporting Western nations would come and save them.  Ney!  What a bunch of stupid fools.

What is insane about this whole episode of the last days of the war which your ICG report seems to be carping about is that none of you international bleeding hearts demanded  from Prabhakaran to lay down the Tamil Tiger arms and surrender when the prognosis of their surviving this war  was zero.  But you all stand guilty in my eyes for trying to save these serial killers by pressuring the Sri Lankan Government to declare a ‘ceasefire’ to save the top Tamil Tigers, thus exposing the Tamils in his human shield to life threatening danger.   And those who were not lucky to run to the arms of the Government soldiers eventually died caught in the cross fires and the deliberate shootings by the Tamil Tigers not wanting them to abandon the human shield.  Were you all not a bunch of cone-heads?  Should you, be charged of suspect criminality for producing this farcical report as a cover up for your human rights crimes in an International War Crimes Court?  I say, most definitely ‘Yes’.  You have little reason to blame the Sri Lankan Government when you nosey-parkers didn’t perform your part with due diligence, impartially and honestly by trying to get Prabhakaran to surrender and put down their arms.  Not once did you all ask him.

Sri Lanka shouldn’t be penalized for giving back the right-to-life to her 22 million peoples, the profound tenet of Human Rights which your group advocate, by decimating the obstinate Tamil Tigers.  So what are you griping about ICG?

Sri Lanka shouldn’t be penalized for giving back to the civilized world a life without the most ruthless terrorist group, the Tamil Tigers who taught the other international terrorists how to kill with human bombs.  So what’s your problem ICG?

Louise, you are an intelligent woman with a legal mind, and let’s be serious about this Eelam War in which the Sri Lankan Armed Forces did the Tamil Tigers in and buried them under a foot of kabook soil after they created mayhem for 27 long years, killing, massacring thousands of innocent civilians, snuffed out two heads of states, Rajiv Gandhi of India and Ranasinghe Premadasa of Sri Lanka, and abducted and recruited over 5,300 children under the age of 14 to train them to be their Baby Brigade to be sent to the font line to fight an adult war only to be mowed down like tender flowers in the poppy fields of Kandahar.  And specially the young girls were also trained to be suicide bombers.

This whole issue that you have taken upon yourself hoping to teach Sri Lanka’s President Mahinda Rajapaksa a lesson of  white-colonial bully power, should be based on the ‘Cosmic Law of Cause and Effect’. 

Let us be reasonable. This war would not have happened if not for someone instructing the bare footed Tamil Tiger guerrillas who couldn’t shoot straight prior to July 1983, and did not know-how to pull a pin off a hand grenade to throw it at the enemy.  This war would have never happened or prolonged for 27 blooding years unless these Tamil Tigers were provided oxygen to sustain themselves by someone providing sophisticated modern weaponry or monies to purchase conventional army weapons to fight a conventional war.

If you pry to find out who this “someone” who was aiding and abetting this war, you will soon find out were countries like India, Norway, Canada, UK, US, France, Germany, Australia and many more country NGOs from the West that surreptitiously helped these unelected bunch of  Tamil thugs to fight a democratically elected Government and its armed forces for the want of their separate state which they had no right, historically, archaeologically, ethnographically or geographically.  And they turned out to be terrorists as their motive for the killing and maiming thousands of innocent civilians was to create their mono-ethnic, separate, racist, Tamil state, Eelam.

During  Ottawa’s convicted terrorist Momin Khawaja’s trial in an Ontario Court, the terrorist act was defined as one being committed for a political, religious or ideological purpose, objective or cause, and that motive distinguishes from other crimes. Thus the Tamil Tigers had the political, ideological purpose and objective for this war which made them “Terrorists’ by definition.   Being a lawyer, you will no doubt acknowledge that definition, I am sure.

You know that in law, an ‘accomplice’ is a person who actively participates in the commission of a crime, even though they take no part in the actual criminal offence.  For example, in a bank robbery, the person who points the gun at the Bank teller and demands for the money is guilty of armed robbery.  However, anyone else directly involved in the commission of the crime, such as the lookout or the getaway car driver is an accomplice, even though in the absence of an underlying offence keeping a look out or driving a car would not be an offence in the normal sense.

So at law, an accomplice has the same degree of guilt as the person he or she is assisting the execution of the crime.

Thus I have difficulty to understand why you and your International Crisis Group (ICG)  have not gone after the accomplices of the Eelam War and charged them of War Crimes in an International War Crimes Court for helping the Tamil Tigers kill, massacre, and maim thousands of innocent civilians for the want of their Eelam (motive), when India, Norway, Canada, US, US, France, Germany and Australia were direct accomplices of  the Eelam War.  Or is that you and your ICG group have difficulty to go that route as they happen to be your paymasters who provide you all a pay cheque at the end of the month for being their sordid mouth pieces singing in harmony their song – We Gotch Ya Sri Lanka…yea…yea…yea!

Here is some food for your thoughts Louise.  Can transnational corporations or their executives be held criminally or civilly liable for aiding and abetting human rights violations committed by governments or militaries of foreign countries where they do business?  Likewise, can this be applied to terrorist groups as well as to the post-9/11 terrorism?  What body of law determines the answer?  Is it International law, law of the foreign state, or the law of the home state?

For corporate executives, whether they can be held criminally liable as accessories to crimes (watch out Norway’s Eric Solheim) against human rights has long been clear.  As early as 1946, for example, the British military court convicted two top officials of the firm that supplied Zyklon B to Nazi gas chambers as accessories to war crimes.  Thus should countries like the US, UK,  Norway, India, Canada and other western nations be criminally libel for being accessories for aiding and abetting the Eelam war against violations of Human Rights in Sri Lanka? And there you are Louise and work that out.  Why the heck are you going after puny Sri Lanka when the liability for human rights violations during the Eelam War are clearly elsewhere?

You bet, the question of the proper scope of liability of corporations and their executives for aiding and abetting human rights violations is far from academic.  Consider the following issues that provided enough reason to sue transnational corporations under the Alien Tort Statute (ATS) for alleged aiding and abetting human rights violations.  Well, where does the US, Norway, India and Canada fit in to this scenario with their involvement with the Tamil Tigers who killed thousands of innocent civilians in Sri Lanka?

-         Caterpillar was sued for selling bulldozers to the Israeli military, which were used to demolish Palestinian homes;

-         Banque Nationale Paris Paribas,  was sued for alleged payments to Saddam Hussein’s regime in violation of the rules of the United Nations oil-for-food program; and

-         Drummond mining company was sued for allegedly paying Colombian paramilitaries who murdered labour activists.

Well…get off your butt Louise and do what is fair for the victims who were killed and maimed by the Tamil Tigers. And here’s what the accomplices of the Eelam War Crimes did:

India:  If India did not train these barefooted Tamil guerillas to graduate them as terrorists, this Eelam War would have petered out within months in 1983-84.

India is guilty of training these Tamil guerrillas from the following groups:  EPRLF (Eelam Peoples Revolutionary Front); TELO (Tamil Eelam Liberation Organization); PLOT (Peoples Liberation Organization of Tamil Eelam); EROS (Eelam Revolutionary Organization); TELA (Tamil Eelam Liberation Army).  All of them were provided  military training by the Indian Government at the following locations:

1. @ Parangimali and at a place about 40 km from the Madras airport. Indian instructors trained them on firing practice, leopard crawl, monkey crawl, ghost walk, close quarter unarmed combat, first aid, preparation of Molotov cocktails, fire-fighting endurance tests;
2. @Salem Kollimalai Kanjipuram. Trained by ex-Subedar Major Narashima Varman of the Indian Army on drill, PT military subjects;
3. @Kollimalai, Kakavel. Training given on AK47, G3, pistols, SLR, LMG, SMG, No.36 Browning revolvers, Rocket launchers, 2” Mortar explosives;
4. @ Sengalpattu, Thanathur, Kongurukolam in Erodi.  Trained by Sekar, a retired Indian army soldier on Military tactics, guerrilla warfare, jungle warfare, handling of weapons – 380 & 450 revolvers and 22 air rifles;
5. @Sadtagen Development Area adjoining Canal Park in New Delhi.  Trained by Narayan and two others from the Indian government on manufacturing of bombs, handling of SMGGs, AK47s and pistol. And there were umpteen other military training camps.

So Louise Arbour and your International Crisis Group – what the heck are you waiting for? Go after India for aiding and abetting this Eelam War which violated Human Rights which you bleeding hearts seem to be policing.  Let’s see some honesty here!

NORWAY:  * The Norwegian government helped the Tamil Tigers to establish a relationship with Eritrea which allowed the terrorist group to purchase arms, ammunition and equipment from China on Eritrean end-user certificates. This tripartite understanding had been reached in Norway as far back as 2002-2003. 

If you don’t believe me, just ask KP  (Kumaran Pathmanathan) who is now in custody in Sri Lanka who will tell you that over 90 percent of all heavy equipment, including  a range of artillery pieces and 14.5mm four barrelled anti-aircraft guns were in that deal and brought over to the  Tamil Tigers along the east coast Mullaitivu beaches at night.

*Norway participated in smuggling of high-tech communication equipment to the Tamil Tigers.  Norwegian generals also gave the Tamil Tiger leaders sensitive information.  General Trygve Tellefsen leaked information about the Sri Lankan Navy pursuit of a Tamil Tiger arms smuggling ship to the Tamil Tigers allowing them to escape.  He was leading the Scandinavian Peace Monitoring Group.  After the incident Sri Lanka’s President Chandrika Kumaratunga complained to Norway’s Prime Minister Kjell Magne Bondevik to remove the Head of the Monitoring Mission, and the Retired Major General Trygve Tellefsen was removed immediately.

* Telephone wiretaps had revealed the close cooperation between the Norway Government and the Tamil Tiger terrorist leaders.

Wiretap 1 – Norwegian Ambassador Jon Westborg and Duleep from the Tamil Tigers indicated that the ambassador giving information about the communication equipment and informed that the Norwegians will pay for the added costs.

A total of six tons of electronic equipment was delivered to the Tamil Tigers in 2002, including V-Sat equipment used in satellite communication.

Wiretap 2 – This was a conversation between Norwegian General Trond Furuhovede and the Tamil Tiger political leader Puleedevan. In it sensitive information was passed on to the Tamil Tiger Puleedevan and coaching him to put the blame on the latest terrorist act to a ‘Third party” wearing stolen  Sri Lankan army uniforms.  The General also states, “I’m using all their resources to calm down the Sinhalese part of the population”, and requests Puleedevan to order his people to do the same.

Louise, both these wiretaps were made in the autumn of 2002.

*Norwegian ex-Special Forces were also used to train Sea Tigers to attack Sri Lanka.  The training was given by these Norwegians along Thailand’s Andaman Coast, “To strengthen the Tamil Tiger capability to attack Sri Lanka’s navy, which included training on underwater demolition strikes.  Among the confiscated weapons which were used during this training mission were Swedish Carl Gustav missile launchers, the type that are used by the Norwegian Army, HK Mark 23s and Glock’s with silencers, also used by Norwegian Special Forces and SWAT teams.

Louise, put on your lawyers cap.  If all the above are not aiding and abetting by the Norwegians, then what is it?  Show us some guts and honesty lady.  Go after these bastard stinky lutfisk eating Vikings and haul them in front of an International War Crimes Court.  Why play with small fry like puny Sri Lanka which had every right to defend its sovereignty and its innocent people from sure death with planted claymore mines, by the marauding Norwegian helped Tamil Tiger terrorists.

Louise, if you think that going after Norway is going to diminish your chances of getting a Nobel Peace Prize, just forget it.  Stop dreaming as I will tell you right now, you just don’t have a chance in hell….so go after these Viking bastards who helped the Tamil Tigers to kill my people –pregnant mothers, children and infants in cold blood.

CANADA:  For 13 long years during the Liberal Government administration they let the Tamil Diaspora collect two million dollars a month to stuff the Tamil Tiger war-chest to buy sophisticated military weapons to fight their separatist war in Sri Lanka;

-          CSIS, Canada’s national intelligence agency, identified the World Tamil Movement (WTM), the Federation of Associations of Canadian Tamils (FACT) and the Tamil Eelam Society of Canada as key organizations of the Tamil Tigers raising funds for the group in Canada;

-         On May 6, 2000, Liberal Government’s Finance Minister Paul Martin (later became Prime Minister) and Maria Minna (Minister for CIDA) attended a $60-per plate fund raiser organized by FACT for the Tamil Tiger terrorists.

“FACT is a fundraising organization for the Tamil Tigers, that’s well established.  Yet, even though our own security agency has made that very clear, the Finance Minister and other ministers go to these sorts of events and put money into that organization,” said Monte Solberg, Canadian Alliance MP in parliament.

-         In 1994, the Canadian Government let the Tamil Diaspora cut a cheque for 7 1/2 million dollars from a bank in Vancouver to buy 50 tonnes of TNT and 10 tonnes of RDX explosive material from a Ukraine chemical plant.  The bank account that paid for the purchase was held by a Canadian.

 On January 31, 1996, these explosive materials were used in a truck bomb which brought down the Central Bank building in the capital Colombo killing 114 innocent civilians and maiming for life another 1,400.  The same explosive materials were used to bomb the entrance to the Temple of the Buddha’s Tooth relic in the hill city, Kandy, on January 25, 1998, killing12 innocent pilgrims and injuring another 13.

 If all these killings by the Tamil Tiger terrorists were due to aiding and abetting by Canada, so why are you waiting to charge Canada  in an International War Crimes Court for its criminality in its involvement with the Tamil Tigers.

 What’s your problem Louise Arbour?  What’s your problem International Crisis Group?  Show your gumption and get on with it.

 Let’s cut out this pithy nonsense about War Crime Investigations against the Sri Lankan Government for getting rid of a world menace, a cancer, the Tamil Tigers. Let us see your guts to go after the big fish, India, Norway and Canada as I have given enough reasons for you to do so.  Take off your blinkers and look at US, UK, France, Germany and rest of the others and you will have enough reasons to have your work cut out  and secure your pay cheques for the next 36 months.

 So do it Louise Arbour.  Show us that you know your business of policing Human Rights violators.   Show us that you have some honesty creeping in your bone marrow.  Show us that you are not a vulgar Pied piper paymaster’s dishonest slave.  Show us that you are honest Canadian and an Ottawan to boot.
